1. Agreement and scope
These Terms of Service are an agreement between you and NAY KO KO OO, trading as Ciel Labs, the provider of Npass 日本語. They govern your access to and use of the application, website, learning content, AI features, community features, and related services. By creating an account or using Npass, you agree to these Terms and the Privacy Policy.
If you do not agree, do not use Npass. Additional terms from Apple, Google, your device platform, or another service provider may also apply to your relationship with that provider.
2. Eligibility
You must be at least 13 years old to use Npass or hold an account. If you are under 18, or otherwise not able to agree to these Terms on your own under the law where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use.
You may use Npass only where doing so is lawful. You are responsible for following laws that apply to you.
3. Your account
- Provide accurate information and keep it reasonably current.
- Keep your device, sign-in method, and account credentials secure.
- Do not share access in a way that compromises the service or another person.
- Notify us promptly if you suspect unauthorized access.
- You are responsible for activity performed through your account to the extent permitted by law.
Npass will never ask you to email your password, access token, or sign-in code.
4. The learning service
Npass provides tools for Japanese vocabulary, kanji, grammar, reading, writing, pronunciation, review scheduling, study progress, and related learning activities. Features and availability may differ by device, account state, location, or release.
We may add, change, limit, or discontinue a feature to improve the service, address safety or legal requirements, or maintain reliable operation. We will provide notice where required by law.
5. AI-generated content and learning limitations
Some Npass features use artificial intelligence to generate or transform meanings, translations, examples, exercises, reading passages, writing feedback, scores, furigana, extracted content, and speech.
AI output may be wrong, incomplete, biased, unexpected, or unsuitable for your situation. Check important language with reliable sources or a qualified teacher. Do not treat an AI score or explanation as an official JLPT result, academic credential, professional assessment, or guarantee of learning progress.
You remain responsible for deciding whether to use, edit, save, publish, or act on generated output. Report harmful or clearly incorrect content so it can be reviewed.
6. Acceptable use
Use Npass for lawful learning and community participation. You must not:
- Upload, publish, or request content that is unlawful, fraudulent, threatening, exploitative, hateful, sexually abusive, or intended to harm another person.
- Infringe copyright, trademark, privacy, publicity, confidentiality, or other rights.
- Upload personal or confidential information about another person without a lawful basis and any required permission.
- Impersonate another person, misrepresent your identity, or manipulate reports or community activity.
- Harass users, publish spam, distribute malware, or attempt phishing or credential theft.
- Probe, bypass, disrupt, or misuse authentication, rate limits, quotas, moderation, access controls, queues, storage, APIs, or network protections.
- Use automated methods to scrape, overload, reproduce, or commercially exploit the service except where we have given written permission or the law expressly permits it.
- Reverse engineer or circumvent technical protections except to the limited extent that applicable law does not allow that restriction.
- Use AI features to facilitate wrongdoing or to generate content that violates these Terms.
7. Your content
You keep any rights you have in content you create and submit, such as custom cards, essays, instructions, and community sets. You are responsible for that content and for having the rights and permissions needed to submit it.
You grant Npass a nonexclusive, worldwide, royalty-free license to host, process, transmit, reproduce, and display your content only as needed to provide, secure, maintain, moderate, and support the service, comply with law, and enforce these Terms.
When you choose to publish a community set, that license also permits Npass to make the set available for other users to discover, view, and import. You can unpublish or delete the source set through available controls. Copies that other users already imported for offline study may remain on their devices.
Do not submit confidential information or content you do not want processed as described in the Privacy Policy.
8. Feedback
If you send ideas, suggestions, or other feedback, you allow Npass to use it without restriction or payment to improve the service. This does not transfer ownership of your other content or personal information.
9. Npass and third-party rights
Npass, its design, software, service structure, branding, and original content are owned by or licensed to the provider of Npass and are protected by applicable intellectual-property laws. These Terms give you a personal, limited, nonexclusive, nontransferable, revocable right to use the service as intended.
Npass also includes third-party and open-source software, fonts, icons, datasets, and learning resources. Their licenses and notices remain applicable. See the Acknowledgements and Licenses pages for available details.
10. Community moderation
We may review, restrict, hide, remove, or preserve community content and related records when reasonably needed to enforce these Terms, investigate a report, protect users, comply with law, or maintain service integrity. Moderation decisions can be made with limited context and may later be corrected.
To report a community set or appeal a moderation action, use the available in-app control or email support@npassnihongo.com. Include the relevant set or report details without sending your password.
11. Third-party services
Npass relies on or links to third-party services, including account providers, cloud infrastructure, AI models, app stores, and external websites. Their services are governed by their own terms and policies. Npass is not responsible for a third-party service outside our control.
12. Privacy
The Privacy Policy explains how information is processed when you use Npass. By using the service, you acknowledge that processing described there.
13. Suspension and termination
You may stop using Npass at any time and may permanently delete your account through the Profile screen.
We may limit, suspend, or terminate access when reasonably necessary for a serious or repeated breach of these Terms, risk to users or the service, unlawful conduct, a security incident, a provider requirement, or a legal obligation. Where appropriate and legally permitted, we will try to provide notice and an opportunity to correct the issue.
After termination, your right to use the service ends. Provisions that by their nature should continue, including ownership, licenses already granted for necessary records, disclaimers, responsibility for prior conduct, and dispute provisions, remain in effect.
14. Disclaimers
To the maximum extent permitted by applicable law, Npass is provided on an "as available" and "as is" basis. We do not promise uninterrupted access, error-free operation, perfect synchronization, permanent availability of any feature or content, or that every AI output is accurate.
Npass is an educational tool. It does not replace a qualified teacher, official examination materials, medical advice, legal advice, financial advice, or another professional service.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
15. Responsibility and liability
You are responsible for lawful use of the service, your submitted content, and reasonable protection of your account. To the maximum extent permitted by applicable law, Npass is not responsible for losses caused by matters outside reasonable control, your misuse of the service, reliance on unverified AI output, or third-party services.
Nothing in these Terms limits or excludes liability where applicable law does not permit that limitation or exclusion. Mandatory consumer protections remain available to you.
16. Applicable law and resolving concerns
If a concern arises, contact support@npassnihongo.com first so we can try to resolve it directly. Most questions are settled that way.
These Terms and any dispute arising from them are governed by the laws of Japan, without regard to conflict-of-law rules. The Tokyo District Court shall be the court of first instance for any dispute that cannot be resolved directly.
If you use Npass as a consumer, this does not remove the protection of mandatory consumer-law rules of the country where you live, and it does not prevent you from bringing a claim before the courts of that country where the law gives you that right.
17. Changes to these Terms
We may update these Terms when the service, providers, safety requirements, or law changes. The updated Terms will be posted on this page with a new effective date. If a change materially affects your rights, we will provide additional notice where required.
Continued use after updated Terms take effect means you accept them, to the extent permitted by law. If you do not accept an update, stop using the service and delete your account.
